Platform Terms of Use

These terms govern how businesses use the antonIA platform: the conversational assistants that reply on the business's behalf and the dashboard used to manage them.

EFFECTIVE · October 12, 2026

  1. Who provides the service and who these terms apply to

The service is provided by antonIA SpA, Chilean tax ID (RUT) 78.244.701-7, based in Santiago, Chile ("antonIA").

These terms apply to the company or person that contracts the service (the "business") and to the people the business gives dashboard access to (the "users"). They do not govern the relationship with the people who chat with the business's assistant; how their data is handled is described in the Privacy Policy.

By using the platform, the business accepts these terms. Anyone accepting them on behalf of a business confirms that they are authorized to do so.

If the business has a signed proposal or contract with antonIA, what was agreed there prevails over these terms wherever the two differ.

  2. The service

    The platform consists of:

    • AI-powered conversational assistants that reply to messages on the business's behalf on Instagram, Facebook Messenger, WhatsApp and web chat.
    • A dashboard where the business reviews its conversations, corrects its assistant, checks its invoices and pays.

The channels and features available depend on what has been agreed with each business. antonIA may improve or change the platform, and will seek not to substantially reduce the features contracted.

  3. Accounts and access

Access to the dashboard is by invitation. Each user has a personal account, which must not be shared.

The business decides who gets access and is responsible for what those people do in the dashboard. It is up to the business to remove access, or ask antonIA to remove it, for anyone who should no longer have it.

Each user must keep their credentials safe. If the business suspects unauthorized access, it must notify g@heyantonia.com without delay.

  4. Acceptable use

The business and its users agree not to use the platform to:

    • Carry out illegal activities or infringe the rights of others.
    • Send spam or unsolicited messages, or contact people without a legal basis for doing so.
    • Breach the Meta and WhatsApp policies that apply to the connected channels. Complying with them on its own accounts is the business's responsibility.
    • Make or communicate medical, legal or financial decisions without review by a qualified person.
    • Impersonate another person or mislead people about the business's identity.
    • Attempt to compromise the platform's security, access other clients' data, or copy, decompile or overload the platform.
    • Resell the service or give access to third parties outside the business without a written agreement with antonIA.

A breach of this section may lead to suspension or termination of the service, as set out below.

  5. The assistant's content and instructions

The business is responsible for the information it loads into the platform, such as products, prices, opening hours, policies and answers, and for making sure it is accurate, up to date and that it has the right to use it.

Corrections the business makes to its assistant from the dashboard apply immediately to the replies that follow. Each correction is logged with the user who made it and the date, and the business can undo it.

The business is responsible for the effect of the corrections and instructions it applies.

  6. AI-generated replies

The assistant's replies are generated with artificial intelligence and may contain errors, inaccuracies or omissions.

The business must review its assistant's conversations regularly, correct it where needed, and decide in which cases a conversation is handed over to a person on its team.

antonIA does not guarantee the accuracy of every reply or any particular commercial outcome, such as sales, bookings or conversions. The assistant is not a substitute for professional advice.

  7. Personal data

For the data of the people who chat with the assistant, the business is the controller and antonIA acts as processor: it handles that data on the business's behalf and under its instructions, in order to provide the service.

It is up to the business to tell its customers that their messages are handled by an automated assistant with the support of a provider, and to have a legal basis for processing their data and for sending them messages.

antonIA handles data in line with its Privacy Policy and deals with deletion requests as described on the Data Deletion page. If a person sends antonIA a request that is for the business to resolve, antonIA may coordinate it with the business.

For the data of dashboard users, antonIA is the controller.

  8. Plans, prices and payment

Prices for the service are stated in Unidades de Fomento (UF), Chile's inflation-indexed unit, and are those agreed with each business in its proposal or contract. Any applicable taxes are itemized on each invoice.

The service is invoiced monthly. Invoices are available in the dashboard.

The business can pay on the platform, through an external payment provider, or by bank transfer. When paying on the platform, payment details are processed by that provider under its own terms.

If an invoice is not paid by its due date, antonIA will notify the business. If payment is still outstanding after that notice, antonIA may suspend the service until the account is brought up to date, without prejudice to any adjustments and interest permitted by law.

Price changes are communicated to the business in advance and do not apply to periods already invoiced.

  9. Availability and support

antonIA makes reasonable efforts to keep the platform available and working properly, but does not guarantee that the service will be uninterrupted or error-free.

The platform may be interrupted for maintenance. Where scheduled maintenance may affect the service, antonIA will seek to give advance notice.

The service depends on third parties, such as Meta and the other messaging platforms, infrastructure providers and the payment provider. antonIA is not responsible for interruptions, changes or restrictions imposed by those third parties, including any that affect the business's accounts.

Support is provided by email at g@heyantonia.com and through the channels agreed with each business.

  10. Intellectual property

The platform, its software, its design and its trademarks belong to antonIA. For as long as the service lasts, the business has a limited, non-exclusive, non-transferable right to use it, solely for its own operations.

The business's data and content belong to the business. The business authorizes antonIA to use them only to provide the service to it, which includes improving the replies of its own assistant.

  11. Confidentiality

Each party will keep confidential any non-public information of the other that it learns in connection with the service, and will use it only for that purpose. This obligation continues after the service ends.

Information is not treated as confidential if it is public, if a party already knew it or lawfully obtained it from a third party, or if it must be disclosed by law or by order of an authority.

antonIA will not use the business's name or logo as a commercial reference without its permission.

  12. Limits of liability

To the extent permitted by law:

    • antonIA is liable for direct damage caused to the business by a breach attributable to antonIA. It is not liable for indirect damage or loss of profit, such as lost sales, lost opportunities or reputational harm.
    • Unless otherwise agreed in writing, antonIA's total liability to the business is limited to the amount the business paid for the service in the twelve months before the event giving rise to the claim.
    • antonIA is not liable for the content or instructions the business loads or applies, for use of the platform in breach of these terms, for the acts of third parties, or for unforeseeable events or force majeure.
    • The business is liable to antonIA for third-party claims arising from its content, its instructions or a use of the platform that breaches these terms.

These limits do not apply in cases of willful misconduct or gross negligence, and they do not restrict any rights the law grants the business that cannot be waived.

  13. Suspension and termination

The business may end the service at any time by giving written notice to g@heyantonia.com. Unless a different period has been agreed, termination takes effect at the close of the current billing period. Amounts accrued up to that date remain payable.

antonIA may end the service by giving the business reasonable written notice. It may also suspend or end the service without that notice period, informing the business, in the event of a serious breach of these terms, a risk to the security of the platform or of third parties, or a requirement of the law, of an authority or of the messaging platforms. Suspension for non-payment is governed by the payment section.

When the service ends, and at the business's request, antonIA provides an export of the business's data and deletes it, within 30 days. antonIA may keep information it is legally required to retain, such as tax records.

  14. Changes to these terms

antonIA may amend these terms. Changes are communicated in advance, through a notice in the dashboard or by email, and take effect on the date stated in that notice.

If the business does not agree with a change, it may end the service before that date. Continuing to use the platform after it means accepting the amended terms.

  15. Governing law and courts

These terms are governed by the laws of the Republic of Chile. For all purposes, the parties establish their domicile in the city of Santiago and submit to the jurisdiction of its ordinary courts, without prejudice to any rights the law grants the business that cannot be waived.
